Legal document
These Terms govern the rights and obligations between Skyneting d.o.o. (the SkyHosting brand) and users of its web hosting, VPS server, domain registration, SSL certificate and website malware cleanup services. By accepting these Terms when placing an order, you conclude an agreement in electronic form. Together with the Privacy Policy and the Price List, they form the whole of the contractual relationship.
Language of the agreement. This English text is a translation provided for convenience only. The Agreement is concluded in the Serbian language (see Section 3, "Conclusion of the Agreement in Electronic Form"), and the Serbian version of these Terms is the sole legally binding text. In case of any discrepancy between the two versions, the Serbian text prevails.
These Terms of Service (hereinafter: the Terms) are issued by Skyneting d.o.o., a company registered in the Republic of Serbia, which under the SkyHosting brand provides web hosting, VPS server, internet domain registration, SSL certificate and website malware cleanup services (hereinafter: SkyHosting or we).
The Terms govern the rights and obligations of SkyHosting and every person who orders or uses our services (hereinafter: the User or you), in connection with the conclusion and performance of the agreement on the use of services (hereinafter: the Agreement). The services are available to Users in Serbia and abroad; the Agreement is governed by the law of the Republic of Serbia.
Constituent parts of the Agreement, which you accept together with these Terms, are:
Everything not governed by these Terms is governed by the Law on Contracts and Torts, the Law on Electronic Commerce, the Law on Consumer Protection, the Law on Personal Data Protection, the Law on Electronic Document, Electronic Identification and Trust Services, the Law on Copyright and Related Rights, the Law on Trademarks and other regulations of the Republic of Serbia.
If any provision of these Terms is void or unenforceable, this does not affect the validity of the remaining provisions. A provision that is unfair to a consumer does not bind the consumer, but the Agreement otherwise remains in force if it can survive without it.
You order a Service through the client portal. During ordering and account registration you are required to check the box “I accept the Terms of Service”. By checking that box and confirming the order:
An Agreement concluded in this manner is valid and binding under the Law on Contracts and Torts and the Law on Electronic Commerce. SkyHosting keeps an electronic record of acceptance (date and time, user account, the IP address the order was submitted from, and the version of the Terms in force at that time). This record serves as evidence of the conclusion and content of the Agreement and has probative force under the Law on Electronic Document; its validity cannot be disputed merely because it is in electronic form.
Before concluding the Agreement, the following are available to you in one place (in the portal and on the site): SkyHosting's identity and contact details, a description and the essential characteristics of the Service, the total price including VAT, the payment method and deadline, the duration of the Agreement and renewal terms, these Terms and the Privacy Policy, the technical steps for conclusion, and how to correct incorrectly entered data before the order is submitted. The Agreement is concluded in the Serbian language. SkyHosting keeps a copy of the Agreement; its text is always available to you through the portal and on this page.
SkyHosting confirms receipt of the order electronically, without delay. The Agreement is concluded when SkyHosting confirms the order, and it takes effect once payment is recorded (see the Prices, Payment and Activation section).
By accepting the Terms you confirm that you have legal capacity and are authorised to conclude the Agreement, and if you conclude the Agreement on behalf of a legal entity — that you are authorised to bind that entity. The services are not intended for minors under 15 years of age.
SkyHosting provides the following information-society services:
For dedicated servers and other services outside the standard offer, a separate contract further governing those services may be concluded; these Terms apply to it on a subsidiary basis.
A detailed specification of packages, resources and prices (the Price List) is found on the relevant pages of the site (web hosting, VPS servers, domain registration, SSL certificates) and in the client portal.
SkyHosting provides an information-society service: it does not initiate the transmission of User Content, does not select or modify that content nor select the recipient of the transmission, and is not obliged to monitor content it stores or transmits (Law on Electronic Commerce). The User alone is responsible for the accuracy, lawfulness and correctness of User Content.
SkyHosting reserves the right to develop, improve, change or withdraw individual elements of the Service and infrastructure, applying good business practice and — when a change is material — giving reasonable prior notice. All time references, deadlines and business days are calculated under the regulations of the Republic of Serbia.
To use the Service you open an account in the client portal and choose your own password. You are solely responsible for the confidentiality of your access credentials and for all actions taken through your account. You will not use another person's credentials nor give your own to third parties; if you do so anyway, you are liable for that person's actions.
If you suspect unauthorised access, you must notify us without delay. If, in limited cases of providing support, we ask for your password, you must change it immediately after support is provided.
You must keep accurate and up-to-date contact details in the portal and notify us of any change without delay, and at the latest within 7 days. Notices sent to the last registered e-mail address are considered duly delivered.
Service prices (in these Terms: the Price List) are published on the service pages on the site and shown in the client portal when ordering, uniform for all Users, in Serbian dinars (RSD) and VAT included (standard rate 20%). The price shown in the portal before the order is confirmed forms part of the Agreement.
Payment is in advance, against a pro-forma invoice issued by SkyHosting. The pro-forma invoice must be settled within 7 days of issuance at the latest; if payment is not recorded within that period, the order is not activated and may be cancelled.
Payment methods:
Payment card details (number, expiry date, CVV) are never available to SkyHosting — you enter them exclusively on the bank's or PayPal's own page, in encrypted form. The processing of that data is described in the Privacy Policy.
All payments are made in dinars. An informational display of prices in other currencies uses the middle exchange rate of the National Bank of Serbia. For cards issued abroad, the amount is converted at the card scheme's own exchange rate, so a slight difference from the displayed price is possible. For refunds of amounts paid by card, the refund is made exclusively through the same card scheme (Visa, EC/MC, Maestro), to the cardholder's account.
Activation. Once payment is recorded, SkyHosting activates the service within 48 hours, except during the DNS propagation period following domain registration. SkyHosting issues an invoice for the amount charged. You may cancel the order at no cost within 48 hours of order confirmation, if the service has not yet been activated.
If the User fails to settle a due obligation in time, SkyHosting is not obliged to provide the Service until the debt is settled and may suspend or terminate the Agreement under the Suspension and Termination section.
Services are contracted for the chosen subscription period. Before the period expires, SkyHosting issues a renewal pro-forma invoice for the next period, at the Price List in force at the time of renewal, and endeavours to notify you of the upcoming expiry by e-mail at least 20 days in advance.
If the renewal pro-forma invoice is not paid by the expiry date, the User is deemed not to wish to continue the service: the service is suspended, and the account and data are kept briefly and then deleted, as described in the Suspension and Termination section. SkyHosting is not liable for the consequences of a service or domain not being renewed because payment was not made in time.
No charge is made to a payment card without individual consent. Automatic renewal payment is optional and is switched on in the client portal, with the option to switch it off at any time.
A domain is registered in the User's name — the User is the registrant (holder) of the domain, for the period stated in the registration application, at the applicable Price List and upon recorded payment.
For registration you must provide accurate and complete registrant data and, where applicable, administrative and technical contact data: for a natural person — first and last name, residential address, phone, e-mail; for a legal entity or entrepreneur — business name, registered seat, registration number, tax ID, phone, e-mail and the name of a contact person. For gTLD domain registration you are required to verify your e-mail address upon receipt of the verification message; if you fail to do so in time, the registry may suspend the domain.
Registrant data is forwarded to RNIDS or the competent registry and may be publicly available through the WHOIS service, to the extent determined by each registry. The processing of that data is described in the Privacy Policy. The User is solely responsible for the exact domain name ordered, as well as for the accuracy of registrant data; inaccurate data may lead to suspension of the domain under the registry's rules. SkyHosting may amend the WHOIS or technical data of a domain when necessary for technical operation or at the User's request.
Domain registration and renewal cannot be cancelled and are not refundable once the domain has been registered or renewed — not even if the User changes their mind, nor if the domain name was entered incorrectly — because the registry does not refund the registration fee. Disputes over the right to a domain (e.g. concerning a trademark) are resolved by the competent body under the rules of RNIDS or the relevant registry.
You may use the Service only for lawful purposes and in accordance with these Terms. It is prohibited, among other things, to use the Service for:
Spam — special rules. Intentional spam (commercial or forum) is penalised, after a warning, by automatic blocking of the service it is being sent from. On shared hosting, unintentional spam (e.g. from a script injected by a third party) generally leads to a temporary suspension of the account until the problematic scripts are removed, after which the account is reactivated. On VPS and dedicated servers unintentional spam is treated as intentional and leads to suspension of the server. If it is established that the Service was contracted for the purpose of spam, SkyHosting terminates the Agreement with no right to a refund.
If you exceed your package's resource limits, SkyHosting notifies you and leaves a reasonable period to come into compliance (upgrading the package or optimising); after that period the account may be temporarily suspended. In the case of a serious and immediate risk to the infrastructure or other users, the measure is applied immediately, with subsequent notice.
Temporary suspension. SkyHosting may temporarily restrict or suspend the Service due to: an unsettled due obligation; a breach of the Acceptable Use section; a security risk (compromised account, malicious code, an attack from or on the server); technical or operational reasons to protect the network; or the request of a competent authority. As a rule we notify you in advance and leave a period to remedy the issue; in the case of serious risk, unlawful content or spam, suspension is immediate, with subsequent notice.
Termination by SkyHosting. SkyHosting may terminate the Agreement for a serious or repeated breach of these Terms, for outstanding debt, or where further provision of the Service would be unlawful or unsafe — with notice to the User, and for a serious breach without a notice period. In the case of termination through the User's fault, there is no refund of amounts paid, and the User remains liable for all due obligations.
Termination by the User. You may terminate the Agreement at any time, through the client portal or the contact form. The Service continues until the end of the paid period and there is no refund for the unused portion, except for the rights under the Consumer Rights and Satisfaction Guarantee sections. For services billed monthly, submit the cancellation before the next pro-forma invoice is issued.
Data after the Service ends. After the Service ends, the account and User Content are kept briefly (as a rule up to 15 days for shared hosting, shorter for VPS), and then permanently deleted. You must retrieve your content and backups before the Service ends. Retrieving data during the retention period may be chargeable under the Price List.
For shared hosting SkyHosting occasionally makes account backups as a convenience, but does not guarantee their existence, completeness, correctness or recoverability at any given moment, as the backups are generated by an automated system service. Backups made by SkyHosting do not replace your own copy of your data.
For VPS and dedicated servers, the User is solely responsible for creating and keeping backups, unless a managed-backup add-on has been purchased, in which case the terms of that add-on apply.
You must regularly make and keep your own up-to-date copy of your content and data. Restoring from a backup at your request may be charged by SkyHosting under the Price List.
SkyHosting makes reasonable efforts for the Services to be continuously available, but does not guarantee uninterrupted, error-free operation. Planned maintenance (announced when feasible, as a rule at least 24 hours in advance) and unplanned outages are possible. For shared hosting and standard VPS there is no numerical availability guarantee (SLA).
The sole remedy for a confirmed Service outage caused through SkyHosting's fault is a proportional fee credit for the duration of the outage, upon the User's request.
SkyHosting is not liable for:
Cap on the amount of liability. Except for damage caused intentionally or by gross negligence, and except for liability that cannot be excluded or limited under mandatory regulations (e.g. for injury to life or body), SkyHosting's total liability under the Agreement is limited to the fee the User paid for the specific Service that is the subject of the harmful event, namely: for web hosting — the fee paid in the last 12 months; for VPS servers — the fee paid in the last 30 days, or the fee for the prepaid period if the User paid for several months of VPS in advance; for other services (domain registration, SSL certificates, site cleanup) — the fee paid for that service. SkyHosting is not liable for lost profit, lost revenue, loss of data or business opportunity, nor for other indirect damage.
The above limitations do not affect the rights of consumers, which under the Law on Consumer Protection cannot be excluded or limited in advance — see the Consumer Rights section.
The User undertakes and warrants that they will:
Personal data within User Content. For personal data the User collects or processes through their site or services, the User is the controller and SkyHosting is the processor, and we act only on the User's instructions, in accordance with the Privacy Policy and Article 45 of the Law on Personal Data Protection. The User must have their own legal basis and their own privacy policy for that processing.
Indemnification. The User will indemnify SkyHosting for all damage, costs and reasonable expenses (including legal defence costs) arising from claims of third parties or competent authorities that result from the User's breach of these Terms or applicable regulations, or from the User's Content or activity.
SkyHosting retains all rights to the skyhosting.rs website, the “SkyHosting” trademark and name, the design, texts and tools (e.g. the SSL tools). Nothing in these Terms transfers those rights to the User.
The User retains all rights to their own content. By accepting the Terms, the User grants SkyHosting a limited, non-exclusive licence to store, reproduce and transmit User Content solely to the extent necessary to provide the Service (hosting, transmission, making backups, migration).
Infringement notice (notice and takedown). A holder of copyright, related rights, trademark or another right may submit a reasoned notice through the contact form, with an exact description of the disputed content and its location and an explanation of the infringement. Upon receipt of a proper notice, SkyHosting removes or disables access to the disputed content without delay, retains the content for evidentiary purposes and notifies the User. SkyHosting may terminate the Agreement with repeat infringers.
If you conclude the Agreement as a consumer (a natural person acting outside their trade activity), in addition to your other rights you also have the following, which cannot be excluded or limited in advance:
Right of withdrawal within 14 days. You have the right to withdraw from the Agreement within 14 days of its conclusion, without stating a reason. This right does not exist, or ceases, in the following cases provided for by the Law on Consumer Protection:
If performance of the service has not begun, you withdraw from the Agreement by an unambiguous statement through the contact form. SkyHosting refunds all payments received without delay, and within 14 days at the latest, using the same means of payment.
Complaint (non-conformity). As a consumer you have the right to lodge a complaint about the service provided through the contact form. SkyHosting will respond to you within 8 days of receiving the complaint, in writing or electronically, stating its position on the request and a proposed resolution, and will resolve the complaint within the statutory deadline.
Out-of-court dispute resolution. A consumer dispute may also be resolved out of court, before a body on the list kept by the ministry responsible for consumer protection (the list is published on that ministry's website). Out-of-court resolution does not exclude or condition the right to judicial protection.
Competent court. For disputes with a consumer, in accordance with the Law on Consumer Protection and the rules on territorial jurisdiction, the court of the consumer's domicile also has jurisdiction; this jurisdiction cannot be excluded by the Agreement. The provision on the exclusive jurisdiction of the court in Niš from the Governing Law and Disputes section applies to disputes with Users who are not consumers (legal entities and entrepreneurs).
For shared web hosting SkyHosting offers a satisfaction guarantee: if within 30 days of activation you are not satisfied with the service, you may request a refund through the contact form. SkyHosting refunds the amount paid less a proportionate amount for the days used and less payment processing costs (payment card, PayPal and similar fees).
The satisfaction guarantee does not cover:
This guarantee is a convenience offered by SkyHosting and does not limit the broader rights a consumer has under the Consumer Rights section.
SkyHosting may amend or supplement these Terms and the Price List due to changes in regulations, the scope or manner of providing services, business costs or technical reasons. A consolidated text is published on this page with a new date, and registered Users are notified of material changes by e-mail at least 8 days before they take effect.
If you do not agree with the changes, you have the right to terminate the Agreement at no cost before the changes take effect. Continued use of the Service after the changes take effect is deemed acceptance of the changes.
For consumers: a change to the Terms or the Price List to a consumer's detriment during the term of the Agreement applies only with the consumer's consent, or subject to the consumer's right to terminate the Agreement without adverse consequences.
The Agreement and these Terms are governed by the law of the Republic of Serbia. The parties will first attempt to resolve disputes amicably — by approaching the other party through the contact form (the User) or the User's last registered e-mail address (SkyHosting), with a proposal for an amicable resolution.
If a dispute is not resolved amicably, for disputes with Users who are not consumers (legal entities and entrepreneurs) the exclusive jurisdiction of the competent court in Niš is agreed. For disputes with a consumer, the provisions on jurisdiction and out-of-court resolution from the Consumer Rights section apply (jurisdiction according to the consumer's domicile cannot be excluded by the Agreement). For disputes over the right to a domain, the rules of RNIDS or the competent registry govern.
SkyHosting's failure to invoke a right in a given case does not mean a waiver of that right. These Terms, the Price List and the Privacy Policy form the whole of the contractual relationship and supersede earlier terms and arrangements on the same subject.
Material changes to these Terms take effect on the eighth day after publication at www.skyhosting.rs, unless a later date is stated in the change notice.
